Brooks Sports announced that it has now “officially resolved our differences to mutual satisfaction of all parties” in regards to the lawsuit filed against Nike, Inc., Exeter Brands Group, LLC and Payless ShoeSource, Inc., citing significant trademark infringement and unfair competition relative to the Tailwind athletic footwear line. Brooks said that Exeter/Nike will take steps to distinguish its products from Brooks' in the market, and it will modify the Tailwind Logo to mitigate potential consumer confusion between the two brands.
“We are very pleased with this outcome and our ability to protect our brand and our customers in this way,” said Brooks President and CEO Jim Weber. “We look forward to continuing to deliver the performance running product our customers have come to expect and respect from Brooks.”
