Brooks Sports announced that it has now “officially resolved our differences to mutual satisfaction of all parties” in regards to the lawsuit filed against Nike, Inc., Exeter Brands Group, LLC and Payless ShoeSource, Inc., citing significant trademark infringement and unfair competition relative to the Tailwind athletic footwear line. Brooks said that Exeter/Nike will take steps to distinguish its products from Brooks' in the market, and it will modify the Tailwind Logo to mitigate potential consumer confusion between the two brands.
