Rawlings Sporting Goods Company, Inc. on February 6 filed suit against Easton Sports Inc. in the U.S District Court for the Eastern District of Missouri Eastern Division, alleging infringement on its Titan trademark. According to the filing, Rawlings has used and is presently using the Titan trademark for the sale of baseball and softball products. 

 

Rawlings is the owner of trademark registration number 2,800,769 for the mark Blue Dot Titan and registration number 2,825,591 for the mark Red Dot Titan for softballs.


Rawlings claims that beginning around the summer of 2008 Easton Sports, Inc., began using the name Titan on and in conjunction with the sale of softball and baseball bats.


Rawlings is seeking the impoundment of all advertising and promotional materials that contain any us or reference to the mark Titan, and order that the impounded material be delivered to Rawlings for destruction.  In addition to attorney’s fees and such other compensatory damages and costs from the court, Rawlings is seeking three times the amount of Easton’s profits or Rawlings’ damages, whichever is greater.
