For the second time in less than sixty days Oakley has been able to settle actions taken to protect its XYZ Sunglass Optic Patents. The company last week settled two patent and intellectual property suits that were pending against competitor/customer, Luxottica Group.
The original suit, based on claims by Oakley of “infringement of certain intellectual property rights”, and subsequent settlement cover LUX subsidiaries Sunglass Hut, LensCrafters, Ray Ban Sun Optics, Arnette and Revo as well. A preliminary injunction against Sunglass Hut will be dissolved.
Neither party admitted to any wrongdoing in the settlement, which sees Oakley continue to use its patented XYZ Optics in its twin lens sunglasses and Luxottica able to use an agreed upon alternative method of optical correction for its sunglass products.
OO announced in early April a settlement in a similar action against NYX Golf Inc.
