On September 4, Nike filed a complaint against Synamon Pennington with Houston, TX-based ELS Clothing, claiming that “Pennington is importing, distributing, offering for sale, and/or selling counterfeit shoes bearing exact copies or colorable imitations of the Nike Trademarks.” The complaint goes on to say that “Nike has requested that Pennington cease and deists from her infringing activities. Despite these repeated requests, Pennington continues to sell and offer for sale of the Counterfeit Products.”
