Mammut Sports Group AG has secured an agreement to allow the worldwide and perpetual right to use the German Ortovox patent and the associated international patent family after a German judge found one of its avalanche beacons infringed on the patent.

On Oct. 14, the Higher Regional Court of Dsseldorf ruled that the compass function used by the Mammut Pulse Barryvox avalanche beacon violates the German patent number DE 10 2004 027314 held by Ortovox. The ruling called for an immediate cessation of sales of that particular version of the Pulse Barryvox by the Mammut Sports Group GmbH in Germany.

All past patent infringements have been settled with the agreement. The Pulse Barryvox with its existing firmware version 3.0 can, with immediate effect, be sold again in Germany by the Mammut Sports Group GmbH.

The patent case came up, because Mammut believed in error that they had a simultaneous development. This did not correspond to the timeline of the patent applications.

Ortovox and Mammut would like to apologize again for the inconvenience and disruption that resulted from the case.
