ASICS Corporation of Japan and its American subsidiary have together filed two separate lawsuits in the U.S. District Court for the Central District of California for patent infringement. Both suits name Target Corporation as a defendant, while the first adds Mossimo, Inc. and the second adds Blue Marlin Corp. and Roma Atletica S.R.L. Unipersonale to the mass market retailer. Both lawsuits are for claimed trademark infringement, unfair competition, trademark dilution, and false advertising.
ASICS is seeking permanent injunctions against these companies to prevent any future sales and distribution of shoes that the company feels bear a stripe design similar to ASICS stripe design. In addition, ASICS is also seeking damages, including profits and attorney fees.
