VF Corp has tracked down the source of some illegal EASTPAK backpacks coming into the E.U. It appears that MCCS Trading of Holland, has been distributing backpacks that originated in the U.S. to Dutch customers via their website .
VF Corp. alleges that this practice infringes on their trademark rights to the EASTPAK name. The company sent MCCS a cease and desist letter, which the Dutch company has subsequently signed. Under the terms MCCS will no longer import or distribute EASTPAK product without the permission of VF Corp. VF will also receive 10,000 for each product or for each day that MCCS Trading fails to comply with the stipulations set forth in the agreement.
VF Corp has obtained information regarding the U.S. suppliers for MCCS, the number of packs sold and still in stock, and the profit made on each pack. A company spokesperson said, “VF Corporation will not hesitate to defend its trademark rights in other cases.”
