Oberwangen, Switzerland (27 March 2024)—After the Swiss Federal Patent Court and previously the Unified Patent Court ordered a preliminary prohibition on manufacturing and marketing against Revolt Zycling AG due to patent infringement for its previously marketed Opium-bikes, myStromer AG is now resolving the legal dispute with a settlement. Revolt Zycling signed a binding cease-and-desist declaration and agreed to pay a confidential settlement amount. The patent-infringing Opium bikes from the first generation are banned from being offered for sale in Switzerland and in various markets of the European Union. The proceedings before the Unified Patent Court were settled in February 2024 already after Revolt Zycling admitted the patent infringement.
MyStromer had also filed a lawsuit against Revolt Zycling on the grounds of design infringement. The contested design corresponds to the award-winning design of the Stromer ST7. As part of the settlement, Revolt Zycling rescinds the nullity claims against the Swiss and European Stromer design raised as a reaction to said lawsuit. myStromer further grants to Revolt Zycling a design license for the frame of certain bike models.
For many years, myStromer has invested considerable resources into the further development, road safety and optimization of premium Speed Pedelecs and has contributed to their technological improvement to a significant extent. As such, the protection of Stromer technologies and the associated fostering of its intellectual property is an important part of myStromer’s efforts. The Co-CEOs Karl Ludwig Kley and Tomi Viiala agree: “We support honest competition, as it stimulates the market and highlights the appeal of S-Pedelecs as a means of transport for commuters. But we will not tolerate reproduction of our technical innovations and our protected designs.”
