Columbia Sportswear Co. is suing Stuart and Kimberly Utgaard, owners of Sportsman's Warehouse, which filed for bankruptcy on March 22. Filed in the U.S. District Court in Oregon, the suit claims that Columbia Sportswear sold Sportsman's “a considerable amount of product and merchandise” totaling $600,000 on credit that has not been paid, according to the Oregonian.


The suit claims Columbia holds a personal guaranty signed by the Utgaards in 1998 that states that the defendants “unconditionally personally guarantee to Columbia Sportswear Company, as Creditor, the prompt payment, when due, of every claim, credit charge, account past due, service charge, attorney's fees of money due that may hereafter arise in favor of the Creditor under this extension of credit.”


Columbia claims that the Utgaards have failed to fulfill those obligations, despite repeated “demanded payments,” and is therefore owed at least $600,000.
