BOB Trailers Files Complaint Against Baby Jogger…

BOB Trailers, Inc. has filed a complaint against Baby Jogger for Trade Dress infringement. The suit was filed on June 14, 2007 in Idaho District Court. The complaint alleges that Baby Jogger made a conscious choice to develop their ATS stroller (right) to look very similar to a BOB Revolution stroller (left), thereby trading on the goodwill of BOB and the Revolution. This action, BOB alleges, violates Trade Dress law, which protects against marketing and trading “Confusingly Similar” products.

BOB Trailers, Inc. has filed a complaint against Baby Jogger for Trade Dress infringement. The suit was filed on June 14, 2007 in Idaho District Court. The complaint alleges that Baby Jogger made a conscious choice to develop their ATS stroller to look very similar to a BOB Revolution stroller, thereby trading on the goodwill of BOB and the Revolution. This action violates Trade Dress law, which protects against marketing and trading “Confusingly Similar” products.

Roger A. Malinowski, president and CEO of BOB Trailers, Inc., stated, “From the beginning BOB has based its competitive strategy on designing and developing unique products with distinctive and identifiable features. Many of these features are uniquely associated with BOB and identify products as our own. We have invested heavily in the research and development of our products; therefore, we will invest in protecting our products and customers from this and future imitations.”
