Lululemon on Monday filed a lawsuit against Peloton over “copycat products” in Peloton’s new apparel line. The lawsuit, filed in Los Angeles federal court, arrived five days after Peloton sued Lululemon in Manhattan federal court, seeking a declaration that Lululemon’s claims had no merit.

In a letter dated November 11, 2021, addressed to Peloton, Lululemon threatened to sue the company unless it halted sales of the alleged knockoffs. Peloton’s launched its private label line in September, following the end of its five-year co-branding relationship.

In the lawsuit, Lululemon is seeking triple damages for its rival’s alleged “willful” infringement of six design patents. Lululemon said five Peloton women’s bra and legging products—Strappy Bra, High Neck Bra, Cadent Peak Bra, Cadent Laser Dot Bra and Cadent Laser Dot Leggings—infringed its patents. It also said Peloton’s One Lux Tight, shown lead photo, copies its Align pants, one of its top sellers.

Peloton “intended to closely copy Lululemon’s proprietary designs and pass off its goods as Lululemon’s high-quality products to misappropriate the immense goodwill that Lululemon has spent enormous time, effort, and expense to cultivate,” Lululemon said in court papers.

Peloton refuted the charges in its lawsuit.

The cases are Lululemon Athletica Canada Inc vs. Peloton Interactive, Inc, U.S. District Court, Central District of California, No. 21-09252 and Peloton Interactive, Inc. vs. Lululemon Athletica Canada, Inc., U.S. District Court, Southern District of New York, No. 21-10071.
