Kwik Tek Inc. is suing Nash Manufacturing Inc. and Wow Watersports LLC, saying the companies have infringed on Kwik Tek’s patent for its Sportstuff Booster Ball and Airhead Bob products. 

The complaint filed in U.S. District Court for the District of Colorado says that Nash and Wow “acted willfully and wantonly in disregard of Kwik Tek’s rights.”  The complaint says that they infringe on Kwik Tek’s U.S. Patent No. D720,030 issued in 2014.  The complaint also reveals that Kwik Tek has a utility patent pending relevant to these items.

The attorney representing Kwik Tek stated in court documents that the defendants “induced infringement willfully and wantonly and with full knowledge of the harm to Kwik Tek and Kwik Tek’s rights; and therefore Kwik Tek is entitled to increased damages under 35 U.S.C. §284 and attorneys’ fees under 35 U.S.C. §285.”  Kwik Tek is also seeking a permanent injunction to prohibit future sales of these products.
