The U.S. House of Representatives passed the Food Safety Enhancement Act of 2009 late last week and as a part of the legislation, Bisphenol A may be banned for use in plastic water bottles.

According to OIA’s legislative update, the act sets a December 31, 2009 deadline for the Secretary of Health and Human Services to determine that the use of Bisphenol A in plastic water bottles and food containers poses no threat to human health.

If the Secretary is unable to determine that Bisphenol A does not pose a threat, the Secretary will have the authority to revoke or modify any of the approved uses of Bisphenol A (including uses in water bottles and food containers).  

The Secretary will also be required to make a public announcement that a determination has or has not been made.
