ICON Health and Fitness, Inc. announced the U.S. District Court Western District of Washington on Wedneesday dismissed the last vestiges of claims asserted by The Nautilus Group. The Court's ruling marked, for practical purposes, the end of Nautilus' claims of infringement against ICON's CrossBow by Weider.
“We're pleased with the Court's ruling that dismisses this issue,” said Brad Bearnson, General Counsel for ICON. “We have always been confident that our proprietary design of the CrossBow by Weider did not infringe the Bowflex patents. While we suspect that Nautilus may appeal the judge's ruling, we are confident that the result will not be altered on any appeal.”
A separate trademark infringement claim by Nautilus is not part of this ruling. The trademark infringement case is currently waiting for a trial date in 2004.
