A federal judge has dismissed the $3.75 million lawsuit filed against Gander Mountain Inc. by the husband of a woman killed in the 2009 American Civic Association shooting.
Samir Muhammad Al-Salihi whose wife, Layla Salman Khalil, was among the 13 victims of the shooting, in a legal complaint filed in April 2011 alleged that employees of Gander Mountain’s Johnson City store were negligent in selling gunman Jiverly Wong semi-automatic pistols and ammunition in 2008 and 2009, according to the Associated Press.
U.S. District Judge Norman Mordue dismissed the complaint in a 30-page decision and order issued Friday, putting an end to the two-year legal battle.
“There is simply no evidence demonstrating that prior to the sales of the (handguns allegedly used in the shooting), Gander Mountain knew or should have known that Wong posed an unreasonable risk of harm to himself or others,” Mordue wrote.
