Woolrich Inc. has sued Eddie Bauer Inc. for infringing on its trademark, “The Original Outdoor Clothing Co.” In the lawsuit, Woolrich said it has used the slogan since 1997 on more than $500 million worth of garments plus catalogs and advertisements.


A suit filed Dec. 14 in U.S. Middle District Court contends the “Original Outdoor Outfitter” mark Bauer began using in October causes confusion. The suit also states that when a Yahoo search is conducted for Woolrich, a Bauer ad pops up containing the “Original Outdoor Outfitter” mark, according to the Patriot News in Pennsylvania.


Additionally, the suit states that Eddie Bauer “is intentionally infringing and diluting [the trademark] in bad faith with the intent to derive benefit from [Woolrich’s] reputation.” The suit also claims that Bauer adopted its new slogan with the “intent of deceiving and misleading the public.”


Woolrich is seeking unspecified damages and an injunction to stop Bauer from using the mark.
