Hanesbranes Inc.  filed a trademark infringement lawsuit against Gildan Activewear Inc. The lawsuit claims Gildan's use of TEMPFX infringes on Hanesbrands' X-Temp trademark.

The suit was filed Dec. 5 in U.S. District Court for the Middle District of North Carolina.

Hanesbrands is asking the court to prohibit Gildan from using the TEMPFX name and seeking profits from TEMPFX sales.

Hanesbrands began selling its apparel with the X-TEMP logo in July 2012 and has used Michael Jordan and other celebrities to promote, according to the lawsuit. X-TEMP was trademarked on Aug. 6, 2013 for socks, underwear and T-shirts. Hanesbrands alleges that although Gildan filed an application with the U.S. Patent Office to use TEMPFX in 2005 and 2009, the applications were abandoned.
