According to Outdoor Industry Association’s Trade Policy team, The Canada Border Services Agency made a preliminary determination of dumping this week in respect of waterproof footwear “constructed wholly or in part of rubber and/or thermoplastic rubber (TPR)” from China and Vietnam.

 

CBSA will be charging provisional duties on these types of footwear that are released from the CBSA on or after May 28, 2009. Duties range from 8.9% to 52.3% for products manufactured in China, depending on the exporter and from 5.2% to 49% for products manufactured in Vietnam.


The Canadian Border Services Agency is expected to make a final determination of dumping and respective dumping margins on August 26th which may change the duty rates. Rates will likely be lower or keep the same but could be higher.


The Canadian International Trade Tribunal is expected to hold a one week hearing in August to determine whether the Canadian domestic footwear industry has been injured by alleged Chinese and Vietnamese dumping. A final determination is expected September 26th that could either confirm a finding of injury to domestic industry or the Tribunal may find no  injury, in which case the case would be dropped and all antidumping duties refunded.
